Terms of Service

These Terms of Service ("Terms") govern your access to and use of The Flint App, a mental strength coaching application designed to help users build unshakeable resilience through personalised AI-powered guidance based on The Flint Mind methodology. By creating an account, accessing, or using The Flint App in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms and Eligibility

1.1 Agreement to Terms

By using The Flint App, you enter into a legally binding agreement with us. If you do not agree to these Terms, you must not access or use our services. Your continued use of the app constitutes ongoing acceptance of these Terms, including any modifications we may make from time to time.

1.2 Eligibility Requirements

You must meet the following requirements to use The Flint App:

• Legal Capacity: You must have the legal capacity to enter into binding agreements. If you are using the app on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
• Authentic Use: You must be a real individual user. The creation of accounts using automated systems, bots, or false identities is strictly prohibited. Each user may maintain only one active account.
• Compliance: You must comply with all applicable local, state, national, and international laws and regulations in your use of the app.

1.3 Prohibited Users

The following individuals are prohibited from using The Flint App:

• Individuals who have been previously banned or suspended from the service
• Individuals who are legally prohibited from receiving our services under applicable law
• Individuals who intend to use the service for illegal, harmful, or fraudulent purposes
• Individuals who cannot legally agree to these Terms in their jurisdiction

2. Nature of Service and Important Disclaimers

2.1 Mental Strength Coaching, Not Therapy

The Flint App provides mental strength coaching and resilience building guidance based on The Flint Mind methodology. Our service is designed to help users develop psychological resilience, emotional regulation skills, and mental fortitude through personalised AI-generated responses to journal entries and mood selections.

2.2 AI-Generated Content and Limitations

The personalised responses you receive are generated by artificial intelligence systems, specifically Claude by Anthropic, trained to apply Flint Mind principles to your specific situation. While these responses are designed to be helpful and relevant, they have important limitations:

• Not Professional Advice: AI responses are for motivational, educational, and reflective purposes only. They should not be considered professional psychological advice, medical recommendations, or therapeutic interventions.
• Accuracy Limitations: AI-generated content may not always be accurate, complete, or suitable for your specific circumstances. The AI system, while sophisticated, cannot fully understand the complexity of human experience.
• Personal Responsibility: You are responsible for evaluating the relevance and appropriateness of AI-generated guidance for your specific circumstances. Use your judgment when applying suggestions from the app.

2.3 Crisis Situations and Emergency Resources

We strongly encourage users to maintain relationships with licensed mental health professionals as appropriate for their individual needs. The Flint App is designed to complement, not replace, professional mental health care. If you are currently receiving mental health treatment, please discuss your use of the app with your healthcare provider.

3. User Accounts and Responsibilities

3.1 Account Creation and Security

When you create an account with The Flint App, you are responsible for maintaining the security and confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration and to update this information as necessary to maintain its accuracy.

You are solely responsible for all activities that occur under your account, whether authorized by you or not. You must immediately notify us of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from unauthorized use of your account.

3.2 User Content and Journal Entries

The journal entries, mood selections, and other content you create within The Flint App ("User Content") remain your intellectual property. However, by using the app, you grant us certain limited rights to process this content as necessary to provide our services.

• Content Standards: Your User Content must comply with our community standards and applicable laws. You may not use the app to create, store, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Accuracy and Honesty: While we encourage authentic self-expression in your journal entries, you are responsible for the accuracy of any factual claims you make.
• Privacy and Confidentiality: Your journal entries are encrypted and private. Any content you choose to share should be shared thoughtfully.

3.3 Prohibited Uses

You agree not to use The Flint App for any of the following prohibited purposes:

• Harmful Activities: Using the app to plan, promote, or engage in illegal activities, self-harm, or harm to others
• System Abuse: Attempting to reverse engineer, hack, or otherwise compromise the security or functionality of the app
• Commercial Misuse: Using the app for commercial purposes without our express written consent
• Intellectual Property Violation: Sharing content that infringes on the intellectual property rights of others
• Spam and Abuse: Creating multiple accounts, sending spam, or otherwise abusing the communication features of the app

4. Premium Features and Subscription Terms

4.1 Premium Subscription Services

The Flint App offers premium features designed to enhance your mental strength coaching experience. Premium features may include:

• Unlimited Journaling: Remove any limitations on the number of journal entries you can create per day or month
• Charge Up Boosts: Access to specialized mood and time-based motivational content designed to provide immediate psychological support and energy
• Enhanced AI Responses: Receive more detailed, nuanced, and personalised AI-generated guidance based on deeper analysis of your patterns and preferences
• Advanced Analytics: Access to detailed insights about your emotional patterns, progress tracking, and personalised recommendations for continued growth
• Priority Support: Receive expedited customer support and access to premium user resources

4.2 Subscription Billing and Renewal

Premium subscriptions are billed on a recurring basis according to the subscription plan you select (monthly, quarterly, or annually). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Payment Authorization: By subscribing to premium features, you authorize us to charge your selected payment method for the subscription fee and any applicable taxes. You are responsible for maintaining valid payment information and ensuring sufficient funds are available for subscription charges.

Refund Policy: Subscription fees are generally non-refundable. However, we may provide refunds at our discretion in cases of technical issues, billing errors, or other exceptional circumstances. Refund requests must be submitted within 30 days of the charge.

4.3 Cancellation and Account Termination

You may cancel your premium subscription at any time through your account settings or by contacting customer support. Cancellation will prevent future billing but will not provide a refund for the current billing period. You will retain access to premium features until the end of your current billing period.

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Flint App, including its software, design, content, trademarks, and underlying technology, is owned by us and protected by intellectual property laws. This includes:

• The Flint Mind Methodology: The psychological frameworks, principles, and approaches that form the foundation of our coaching system are proprietary intellectual property
• AI-Generated Content: All responses, insights, and guidance generated by our AI system are owned by us, even though they are personalised for your specific situation
• App Technology: The software, algorithms, user interface, and technical systems that power The Flint App are our proprietary technology
• Branding and Trademarks: The Flint App name, logo, and associated branding elements are our trademarks and may not be used without permission

5.2 Your Intellectual Property

You retain ownership of your journal entries and other User Content. However, by using the app, you grant us a limited, non-exclusive licence to process your content as necessary to provide our services, including generating AI responses and improving our algorithms.

Limited Licence Grant: You grant us the right to use your User Content solely for the purpose of providing and improving our services. This includes processing your content through AI systems, analysing patterns for personalisation, and using aggregated, anonymised data for service enhancement.

6. Privacy and Data Protection

6.1 Privacy Policy Integration

Your privacy is fundamental to our service. Our comprehensive Privacy Policy, which is incorporated into these Terms by reference, explains in detail how we collect, use, protect, and share your personal information. By agreeing to these Terms, you also agree to our Privacy Policy.

As detailed in our Privacy Policy, we use carefully selected third-party services to provide AI-powered coaching responses (Claude by Anthropic and OpenAI Whisper for voice transcription). These services process your data temporarily and securely, with strict contractual protections ensuring your data is not stored, retained, or used for any purpose beyond generating your specific responses.

7. Service Availability and Modifications

7.1 Service Availability

We strive to provide reliable, consistent access to The Flint App. However, we cannot guarantee uninterrupted service availability due to factors beyond our control, including internet connectivity issues, server maintenance, technical difficulties, and force majeure events.

7.2 Service Modifications

We reserve the right to modify, update, or discontinue features of The Flint App at any time. We will provide reasonable notice of significant changes that materially affect your use of the service.

8. User Conduct and Community Standards

8.1 Respectful Use

The Flint App is designed to be a supportive environment for personal growth and mental strength development. All users are expected to use the service respectfully and in accordance with our community values.

8.2 Content Guidelines

Your journal entries and other User Content should comply with basic standards of legality and appropriateness:

• Legal Compliance: Content must not violate any applicable laws or regulations
• Safety Standards: Content should not promote or provide instructions for self-harm, violence, illegal activities, or other dangerous behaviors
• Respectful Expression: While we encourage authentic emotional expression, content should not be gratuitously offensive, discriminatory, or harmful to others

9. Limitation of Liability and Disclaimers

9.1 Service Disclaimers

The Flint App is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to fitness for purpose, accuracy and reliability, uninterrupted service, and absolute security.

9.2 Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury or harm, financial losses, data loss, or third-party actions.

9.3 Maximum Liability

In jurisdictions where liability cannot be completely excluded, our total liability to you for all claims arising from or related to these Terms or your use of The Flint App shall not exceed the amount you have paid us in the twelve months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Flint App, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use of the service, your content, your conduct, or your breach of these Terms.

11. Dispute Resolution and Governing Law

11.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any disputes through informal negotiation. You must contact us at theflintmind@mentalbillionaire.com with a detailed description of the dispute, and we will work in good faith to resolve the matter within 60 days.

11.2 Binding Arbitration

If informal resolution is unsuccessful, any remaining disputes will be resolved through binding arbitration rather than in court, except as otherwise provided in these Terms. You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action.

12. Account Termination

12.1 Termination by You

You may terminate your account and stop using The Flint App at any time for any reason. To delete your account, you can use the self-service deletion feature through the app settings or contact our customer support team at theflintmind@mentalbillionaire.com.

12.2 Termination by Us

We may suspend or terminate your account and access to The Flint App at any time, with or without notice, for violation of these Terms, illegal activity, harmful conduct, fraudulent activity, or extended inactivity.

13. International Use and Export Controls

The Flint App is designed to be accessible to users worldwide, subject to local laws and regulations. However, we make no representation that the app is appropriate or available for use in all jurisdictions. You are responsible for ensuring that your use of the app complies with all applicable local, state, national, and international laws and regulations in your jurisdiction.

14. Accessibility and Accommodations

We are committed to making The Flint App accessible to users with disabilities and strive to comply with applicable accessibility standards, including the Web Content Accessibility Guidelines (WCAG) and relevant local accessibility laws. 15. Changes to Terms of Service

We reserve the right to modify these Terms of Service at any time to reflect changes in our services, legal requirements, or business practices. When we make changes, we will update the "Last updated" date at the top of these Terms.

For significant changes that materially affect your rights or obligations, we will provide notice through in-app notification, email notification, or website notice. We will provide at least 30 days' notice for material changes, except when changes are required for legal compliance or security reasons.

16. Miscellaneous Provisions

16.1 Entire Agreement

These Terms of Service, together with our Privacy Policy and any additional terms that apply to specific features of The Flint App, constitute the entire agreement between you and us regarding your use of the app.

16.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

16.3 Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign these Terms and our rights and obligations hereunder to any third party without restriction.
